Learn what information must be confirmed before filing and how an application progresses through examination, publication and registration.
A trademark application turns the decisions made during the pre-application review into a formal request for registration. Before filing, the applicant, version of the trademark and goods or services to be protected should already be clearly identified.
Identify the applicant, provide a clear representation of the trademark and list the goods or services under the appropriate class.
An application may cover one or several classes. The applicable official fee is payable for every class included.
Use clear, specific descriptions that accurately cover the applicant’s activities and fit the selected class.
Check the acknowledgement promptly. The application covers only the trademark shown and goods or services listed.
The application progresses through five stages. It must pass through examination and publication before registration can be completed.
The applicant, trademark and goods or services are identified in the application.
The applicant’s details, representation, classification and other formal requirements are checked.
The Registrar considers whether the trademark satisfies the legal requirements for registration. Possible interruption: Provisional Refusal.
An accepted application is published for a two-month opposition period. Possible interruption: Notice of Opposition.
If no opposition is filed, or an opposition is resolved in the applicant’s favour, the trademark proceeds to registration.
A provisional refusal generally requires a response within the prescribed period. If none is filed, the application may be treated as withdrawn.
An extension may be available where permitted. Request it before the original deadline expires; approval should not be assumed.
